Dear All

I have a client who owes us money, approx £2,900.   We went through moneyclaim online in October 2011, obtained jusgement by default, which has subsequently been set aside based on "not being able to make a defence".  He claimed the bank had bounced cheques, but he hadn't told them not to pay"

The client also notified the court that he wished to make a counter claim, as he thought that we had made some mistakes.   Nothing to support this has been forthcoming in 4 months.

I was wondering if anyone else had taken non-payers to court, what to expect, and generally any useful advice.

Thanks

Lynn

Hi,

I took a company to court a couple of years ago as I was unable to get payment of my final invoice to them for apprx £1200

All your evidence should have already been submitted but I'm not sure that they read it until the day. Answer confidently all questions that are asked of you. Don't interupt like I tried to do when I didn't agree with something, you soon get slammed down! You have to just speak when you are given your turn

I did win at the end and the client was ordered to pay within 28 days including all court fees, needless to say they only paid part of it in that time. I then wrote to them threatening with going back to court and said that they would have to pay further fees. I got the full money in the end

Good Luck on Monday!
