National Minimum Wage

Hi all

Your opinions on this would be gratefully received. Here goes ...

An employee works for a logistics firm as a van driver. The company has it's own 'temp agency' through which it employs the driver. The contract only states a fixed wage at a weekly rate, no basic hours are mentioned. There does not seem to be any set basic hours, it's job and finish. There has been speculation that there is a basic 40 hour week, the rest is classed as overtime (which does not have to be paid). The fixed wage has increased since the contract was signed but only due to the change in the personal allowance.

Now the weekly wage is £201 gross, the rest is made up of allowances. The take home pay is £342.84.

Is this legal? Does this qualify for NMW?
