Holidays and Maternity

Hi all


I am employed by a company and I do their payroll.  There holidays run from Jan to Dec.  A lady there is due to go on maternity leave in March.  I have been asked if she is due all her years holiday before she goes.  I don't see how she can be but I am not 100% sure.


Any help is much appreciated.

Hi Jeanette,

Yes holidays due can be taken prior to going on Maternity Leave or they can be taken after Maternity Leave expires.
In the majority of cases they are taken prior to Maternity Leave. This would mean her Maternity Leave date starts after holidays have been used up.

Hi Jeanette, be a little careful. It would be best to confirm the situation with the employer first. Some employers will not roll over holiday into the next year. Depends on the contract of employment. If your client wants to roll over holiday entitlement into the next year, they should get agreement from their employer first. Most employers will agree to this particularly for maternity. Best to obtain an agreement first.

If you go to   https://www.gov.uk/employee-rights-when-on-leave this will confirm the rights of employee on SMP.
