Commercial vehicle lease in directors name

My client is in the first year of trading through a limited company.  Due to the company not having any annual accounts they are unable to purchase any more vehicles on PCP or lease.  

If the finance is through one of the directors and the payments made from the business account, can the VAT and tax still be recovered?

Yes, provided the vehicle is used for business purposes, insured in the company name (watch out for that one, I have had issues in the past with Admiral, Direct Line etc where they say the insurance is in the company name then a claim occurs and the payment arrives made out to the main driver of the vehicle) and registered in the company name.


Remember for VAT puposes you can only claim the 100% if it is a goods/commercial vehicle.


It is surprising how many limited companies over the last few years have had to take out finance on business vehicles or machinery under one of the shareholder/directors names.


I have had a few HMRC inspections with this sort of arrangement and up to now they have all passed where it has been a commercial vehicle, I don't know how it would go with a luxury sedan :)
